Day Nursery Rules and Regulations.
When starting out as a Nursery Franchise owner you must realise that childcare is a sensitive issue. So the amount of red tape surrounding nursery rules and regulations should come as no surprise.
To begin with, following the Children Act of 1989 anyone providing childcare during the day for children under the age of eight that exceeds four hours, must be registered with OFSTED.
This will involve looking at the ability of the proposed facility to be able to provide day care that conforms with the fourteen national standards for day care and childminding. These fourteen standards are based on a combination of standard qualities covering you, the staff and the premises.
Staff must be suitable to look after children, so they must have had a CRB check. The manager, whether or not it’s the franchisor, must also have at least two years experience as a qualified nursery nurse, at least one year in a supervisory position and a relevant childcare qualification.
The training of your staff must include documented Health and Safety training and a protection procedure within the first week of employment. Although it is preferable for all staff to be qualified, it is not necessary, but at least 50% should have a minimum level 2 qualification for a day care setting.
Next you need to adhere to the staff per child and space per child ratios.
- Up to 2 years – 1 member of staff to 3 children & 3.5 sq metres per child.
- 2 – 3 years – 1 member of staff to 4 children & 2.5 sq metres per child.
- 3 – 7 years – 1 member of staff to 8 children & 2.3 sq metres per child.
Then of course there is sanitation. You will need one toilet and hand basin with running hot and cold water for every ten children over the age of two.
The above are statutory requirements which must be adhered to before you will be able to open your doors to the public. There are other guidelines for security, premises and furniture and if I am not careful I will end up writing a book on the subject! The idea behind this post is to give an overview of key day nursery rules and regulations.
